Konami and EA Sports are having a tough battle on Brazilian soil for the licensing of PES and FIFA 18 teams. The situation of the clubs in Brazil is quite delicate because the players are not affiliated with FIFPro and Brasileirão does not have the image rights of the clubs. Thus, in addition to negotiating with each team separately, it is necessary to negotiate with each player, which hinders the licensing.
In recent years the licensing has become much more complicated, when EA was sued by several Brazilian players for misusing its image rights. At that point, Konami got advantage and managed to negotiate with CBF the license of Brasileirão, as well as exclusivity with Corinthians and Flamengo in the last edition of PES.
According to UOL, Corinthians and Flamengo maintains the exclusivity agreement with Konami until the end of this year. Therefore, the inclusion of these two teams in FIFA 18 will not be possible. Also, according to UOL, the marketing department of Corinthians said they are open to negotiations for the next seasons and that "there is nothing defined". Flamengo press office didn't respond on the subject, but the chances of a contract for the next seasons also exists.
